Our largest practice area is general liability litigation. Most frequently, we are retained by insurance companies, private businesses, and third-party administrators to defend the interests of their insureds, themselves, or their principals. Our years of experience gained through a defense-oriented practice allow us to analyze quickly and correctly the issues, risks, and exposures of litigation to enable the earliest possible decision on whether a case can be resolved short of trial.

The involvement of insurers in nearly all of the litigation defense matters that the firm handles has resulted in the firm’s attorneys having an in-depth knowledge of the law interpreting insurance policies and the scope of insurance coverage. Accordingly, the firm is employed with some frequency to opine on insurance coverage questions or to handle declaratory actions on behalf of insurers related to insurance coverage. As a further outgrowth of this work, the firm has been employed to defend several different insurers in response to bad faith claims by insureds who allege their claims were mishandled by their insurer.

These matters have been a growing area of concern for insurers in Colorado. Meeting the challenge these issues and claims present demands a thorough knowledge of insurance law and claims handling as it exists in Colorado, along with a sensitivity and willingness to learn and understand the particular practices of individual insurers and their employees. The firm is also aware that the concerns of the insurer being sued are often felt at levels above those where the acts being examined occurred. Additionally, the public’s reaction to insurance companies adds to the care that must be used in defending the claim.
